These General Terms and Conditions govern access to, booking of, and participation in experiences, events, activities, and services offered through this platform.
Use of this website and the completion of any booking implies full acceptance of these terms and conditions.

2. PURPOSE OF THE SERVICE
EL ENCUENTRO offers an experience that may include lodging, dining, transportation, organized activities, and other services provided directly or through third-party partners.
Any booking made through this platform constitutes a binding electronic reservation.
3. RESERVATION AND BOOKING PROCESS
The booking is finalized by:
- Selecting the experience.
- Filling out the reservation form.
- Expressly accepting these Terms and Conditions.
- Making the corresponding payment.
- Receiving an electronic confirmation sent to the provided email address.
EL ENCUENTRO reserves the right to reject reservations in the event of lack of availability, technical or pricing errors, suspected fraud, or breach of these terms and conditions.
The reservation will only be effective upon receipt of the express confirmation sent via email.
4. PRICES AND TAXES
All published prices include applicable taxes unless expressly stated otherwise.
Prices may be modified at any time prior to the effective booking.
EL ENCUENTRO may offer temporary promotions subject to availability and specific conditions.
5. PAYMENT METHODS
Payments may be made by credit card, virtual POS terminal, bank transfer, or authorized payment platforms.
The platform uses secure, encrypted payment gateways.
EL ENCUENTRO does not store full credit card details.
6. AVAILABILITY AND CONFIRMATION
All reservations are subject to actual availability of seats.
In the event of overbooking, a technical error, or unforeseen circumstances, an equivalent alternative will be offered or a full refund will be issued.
7. CANCELLATION AND REFUND POLICY
7.1 Cancellation by the customer
Specific cancellation terms may vary depending on the experience booked and will be indicated during the booking process.
Unless otherwise specified:
- Cancellations more than 60 days in advance: 100% refund.
- Between 60 and 30 days: 50% refund.
- Less than 30 days: non-refundable.
Bank fees, commissions, or external costs already incurred may not be refundable.
7.2 No-Show
Failure to attend the booked experience will not entitle you to any refund.
7.3 Cancellation by EL ENCUENTRO
EL ENCUENTRO may cancel or modify activities due to:
- organizational reasons,
- weather conditions,
- safety concerns,
- force majeure,
- insufficient participants,
- operational impossibility.
In such cases:
- a date change will be offered,
- an equivalent alternative,
- or a full or partial refund, as applicable.
EL ENCUENTRO will not be liable for indirect expenses resulting from the cancellation, including flights, external hotels, or transportation not booked directly.
8. RIGHT OF WITHDRAWAL
In accordance with Article 103.1 of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to services related to leisure activities, travel, events, or experiences with a specific date or period of performance.
By completing the reservation, the user expressly accepts the loss of the right of withdrawal when the contracted service is associated with a specific date.
9. PARTICIPANT OBLIGATIONS
The participant declares:
- that the information provided is true,
- that they have sufficient legal capacity,
- that they meet the participation requirements,
- and that they will act in a respectful and safe manner.
THE EVENT may deny access to or expel participants who:
- disrupt the activity,
- violate safety rules,
- engage in offensive, violent, or inappropriate behavior,
- or act under the influence of substances incompatible with the activity.
No refund will be issued.
10. MEDICAL CONDITIONS, ALLERGIES, AND PERSONAL RESPONSIBILITY
Participants are responsible for providing advance notice of:
- allergies,
- food intolerances,
- physical limitations,
- relevant medical conditions.
EL ENCUENTRO will act diligently with respect to the information provided, but does not guarantee the total absence of food traces, inherent risks, or situations arising from third-party providers.
The participant assumes the normal risks associated with leisure activities, travel, and group experiences.
11. DOCUMENTATION AND TRAVEL
When the experience requires travel or official identification, the participant is responsible for having valid documentation:
- passport,
- visas,
- permits,
- insurance,
- required health requirements.
EL ENCUENTRO will not be liable for incidents arising from incorrect or expired documentation.
12. USE OF IMAGES AND CONTENT
During the experiences, photographs and audiovisual material may be captured for the following purposes:
- promotional,
- documentary,
- advertising,
- or corporate communications.
Participants may object in advance by providing written notice.
13. INTELLECTUAL PROPERTY
All content on the platform—including texts, images, designs, logos, videos, trademarks, software, documentation, etc.—is the property of EL ENCUENTRO or its licensors and is protected by intellectual and industrial property laws.
Unauthorized reproduction or use is prohibited.
14. LIMITATION OF LIABILITY
EL ENCUENTRO shall not be liable for technical interruptions, errors beyond its control, actions by third-party providers, force majeure, indirect losses, or damages resulting from misuse of the platform.
EL ENCUENTRO’s maximum liability shall be limited to the amount actually paid by the user.
15. DATA PROTECTION
In accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights, and other applicable regulations, EL ENCUENTRO informs users that the personal data provided during the booking, contracting, or contact process will be processed for the purpose of managing bookings and contracted services, processing payments and invoicing, coordinating accommodations, activities, and experiences, managing incidents and customer service, complying with legal obligations, ensuring the safety of participants and the organization, and sending communications related to the contract entered into.
The data may include identifying information, contact details, official documentation, organizational preferences, allergies, food intolerances, or other information necessary for the proper provision of the service.
The legal basis for the processing will be the performance of the contract, compliance with legal obligations, and, where necessary, the user’s express consent.
EL ENCUENTRO will implement the necessary technical and organizational measures to ensure the security, confidentiality, and integrity of personal data.
Data may be disclosed only to suppliers directly involved in the delivery of the contracted service, payment processors, accommodations, logistics providers, insurance companies, and public authorities when legally required.
EL ENCUENTRO will not sell or transfer personal data to third parties for commercial purposes unrelated to the contracted service.
Users may exercise their rights of access, rectification, erasure, objection, and restriction of processing by sending a written request to the email address info@elencuentro.eu
The data will be retained for as long as legally necessary to fulfill contractual, tax, administrative, and security obligations
16. COOKIE POLICY
The EL ENCUENTRO website uses first-party and third-party cookies for technical, analytical, functional, security, and user experience improvement purposes.
Cookies allow us to remember preferences, streamline the booking process, analyze browsing patterns, improve services, and optimize the platform’s performance.

17. PAYMENT SECURITY
EL ENCUENTRO works with secure payment platforms and gateways that use SSL/TLS encryption protocols and strong authentication systems in accordance with the PSD2 regulations applicable in the European Union.
Payments are processed directly by authorized and certified payment service providers.
EL ENCUENTRO does not have access to or store complete banking information regarding credit or debit cards used during the purchase process.
The platform may perform additional security and authenticity checks to prevent fraudulent transactions or unauthorized use of payment methods.
EL ENCUENTRO reserves the right to cancel or block transactions that show reasonable signs of fraud, illegal use, or suspicious activity.
18. MODIFICATIONS
EL ENCUENTRO may update or modify these terms and conditions at any time.
The applicable terms and conditions will be those in effect at the time of booking.
19. GOVERNING LAW AND JURISDICTION
These terms and conditions shall be governed by Spanish law.
The contracted services and experiences shall be deemed to have been provided within Spanish territory.
For any dispute arising from the interpretation, execution, or enforcement of these terms and conditions, the parties shall submit to the competent courts and tribunals in accordance with applicable regulations.”
20. PRE-CONTRACTUAL INFORMATION
Prior to finalizing any reservation or contract, the user will have clear, understandable, and permanent access to information regarding the essential characteristics of the experience or service being contracted, the total price, applicable taxes and any additional charges, payment terms, cancellation and refund policies, accepted payment methods, as well as these General Terms and Conditions.
The booking process will be conducted electronically and may be completed in Spanish or English.
Before definitively confirming the reservation and making payment, the user may review the information entered and correct any errors in the provided data.
The electronic booking confirmation sent by EL ENCUENTRO shall serve as proof of the contract entered into between the parties.
